"Concealed" Weapon
To a sharp-eyed policeman at
the bowling alley, the bulge inside
Freddie's jacket was plainly a
pistol. Arrested for carrying a
concealed weapon, Freddie soon
found himself at the. bar of
justice.
"1 did have this gun," he ac-
knowledged to the judge, "but it
wasn't really concealed. After all,
this policeman was able to recog-
nize it right through my jacket--
just from the shape."
However, the judge found him
guilty as charged. The judge said
a weapon is concealed, in the
legal sense, if it is hidden from
"common observation. ' '
This is the viewpoint courts
usually take. They say it fits the
purpose of a concealed weapon
law: to reassure the ordinary'
citizen, paying ordinary attention,
that the people he meets are not
armed.

"carrying" the weapon? In an-
other case the accused had a
pistol tucked into his back pocket
when he was arrested. But he
pointed out in court that he had
been standing still at the time.
"In fact," he went on, "I
hadn't taken a step since putting
the gun in my pocket. So I didn't
really 'carry' it anywhere."
But the court said "carry"
means merely to have the weapon
in one's possession, regardless of
whether it is moved from one
place to another. Moved or not,
said the court, the latent menace
is the same.
On the other hand, some courts
will exonerate a defendant if he
obviously had no thought of
putting the weapon to use.
One man was picked up while
taking home a gun he had pur-
chased at a sporting goods store.
But the court tossed out the
charge. The court said his act was
not criminal because done with
"lawful purpose."
