ment delivered or mailed under
ORS 311.250 the tax director shall
deliver or mail a form and in-
structions prescribed and furnished
by the Department, on which a
taxpayer may file his claim for
homeowner's property tax relief.
Can the tax collector mail the
form and instructions for filing a
claim in a separate envelope from
the one containing the tax state-
ment? The tax collector could
save postage costs by enclosing a
slip with the statement informing
the taxpayer of the property tax
relief and indicating that a form
would be shipped separately.
ANSWER:
No. Such a procedure would not
cor0ply with the statutory provi-
sions and if a tax statement were
mailed without the claim form,
anyone who did not file his claim
on time could contend that he did
not receive the form, and there-
fore, was not advised of his rights.
